Congratulations on your purchase! Before you get started making ice cream, let's make sure your equipment is registered for warranty. Please read our terms and conditions before filling out the warranty registration form at the bottom of this page.

Our Terms and Conditions

Payment

Payment is due in full prior to shipping or delivery of the merchandise. A 100% deposit is required to initiate build of equipment made to order OR to send a mix test video for used equipment. Deposits are nonrefundable. Once production is complete, you will be notified to pay the remaining balance on equipment. There are no returns once the machine has been shipped. Returns before the machine has shipped will have a 30 percent restocking fee that is mandatory. Credit Card Fees of 3 percent will be charged on any total that is charged via CC. For the best price possible pay by check, wire, ach, or cash.

ICES cannot hold equipment for you without payment of storage fees. Once machines are ready to ship the balance must be paid within two calendar weeks of the customer being informed the machine is ready to ship. Either the factory or the distributor is not able to hold machines without charging a rental fee of 250 dollars per month. Machines in stock with distributor must ship within two weeks of the final payment. Machines on deposit must be paid in full when machines are ready to ship or within six months of the initial deposit being made, whichever applies first. After that, the client will be required to pay storage fee.

Delivery

Unless otherwise explicitly stated, shipping charges are not included in the cost of the equipment. Shipping via LTL or other carrier and/or delivery fees including insurance, liftgate, customs, tax, or other charges are detailed in this invoice, when applicable. When shipping from FL warehouse, the customer will receive pictures of the machines loaded on the truck.

You will be provided with a tracking number for shipments. It is the customer's responsibility to document with photos and videos any damage that occurs in shipping and is noted on the BOL. Customers must be present for the delivery and inspect shipping containers for any visible damage upon arrival. Documentation such as photos or videos is required to submit an insurance claim. If there appears to be any damage, contact your ICES representative immediately, prior to accepting the shipment, for further instruction. Should damage occur during shipping, ICES will work with customers and the insurance and freight companies to receive reimbursement for damages. Failure to mark damage on the BOL and follow the instructions can void the warranty as the insurance will not cover the damage. As long as the customer follows the directions and notes on the BOL of any damage, records with videos and photos, and has the driver call in the damage to the dispatcher the insurance will cover the damage and ICES will support the customer at each step of the insurance process. Failure to mark and or note damage puts the responsibility on the customer.

If the driver is trying to force you to sign for the equipment before inspecting it refuses them. Tell them no. You need to inspect it or you will mark the BOL "subject to inspection possible unseen damage driver refuses to allow inspection."

Installation

Installation of the equipment is the customer's responsibility unless other arrangements have been established. Installation must be conducted by licensed professionals who agree to follow the installation checklist supplied by ICES. Failure to have a licensed electrician, plumber, and refrigeration technician install your equipment can void your warranty.

ICES does not cover labor charges for machine installation or servicing unless other arrangements have been established. Installation and servicing includes electrical & water connections, machine installation, and equipment startup, maintenance, troubleshooting, etc. Customers are provided installation and operation manuals to be reviewed prior to installing and operating the equipment.

Warranty

Each manufacturer provides detailed warranty terms, which are outlined in your invoice and discussed with your sales representative. It is crucial to thoroughly read your manual, follow shipping instructions, and complete any necessary warranty registration. Failure to adhere to the manual, installation instructions, or proper usage may result in voiding the warranty. ICES will collaborate with each factory to ensure their assistance in the warranty process.

Manufacturers' Warranty Terms

Ataforma Molds

All quotes are based on availability once the quote is sent. If customer delays in payment the shipping cost may increase if other customers have bought stock. First paid. First served. 

There are no returns of molds. Once payment is made the molds will ship within 2-3 business days if in stock. Changes in shipping quotes can occur. If the molds are not in stock and are shipped directly from the factory, you will be charged a small customs fee by UPS. Bleach and brine and abrasive scrubbers can damage the molds over time. Make sure you double-check your invoice. And what is on the invoice matches the right molds, cavity amount, mold size, and matching extractors.  Molds can come in various cavities requiring differing extractors and or aligners. Make sure you have properly looked at the specs of the mold you are purchasing.

If the box looks damaged do not accept the parcel. Be present at the package delivery so you can protect your investment. Once the box is accepted there is nothing we can do if there is damage, the mold is yours. There are no returns.

Emerymark Machines

All payments and deposits are non-refundable. 50 percent deposit due to start the build process of machines not in stock. 50 percent balance must be paid for the machine to leave the factory. If machines are in stock 100 percent of the balance is due for the merchandise to ship. All quoted build times are quotes. EmerymarkUSA or ICES cannot give discounts or refunds due to elongated productions, shipping, or customs time. There are no returns.

EmerymarkUSA is not responsible for damage during shipping. Please read the shipping instructions and the machine unloading process carefully. Do not sign the BOL without noting any damage. If the machine is on its side do not accept the machine. Failure to have proper power, ventilation, water, or water temperature may void the warranty. Failure to mark any damage on the BOL can result in the customer paying for service, shipping, and part cost to fix the machine.

Global Equipment

All Global build times are estimates only. 50 Percent Deposit (non refundable) and 50 percent balance due before unit ships. If a unit is in stock and shipping within three weeks, payment is 100 percent. EmerymarkUSA or ICES cannot give discounts or refunds due to elongated productions, shipping, or customs time. There are no returns. Only the Global Factory Warranty applies. ICES will assist the customer in ensuring all factory and warranty support that is supposed to be done by the factory gets done by the factory. EmerymarkUSA is not responsible for damage during shipping. Please read the shipping instructions carefully. Do not sign the BOL without noting any damage. If the machine is on its side do not accept the machine. Failure to have proper power, ventilation, water, or water temperature may void the warranty. They will not bring the machine inside your building or un crate it for you. This is YOUR responsibility. There are no returns. Same applies to parts and accessories. Accessories are 5 percent more purchased without equipment per factory.

Remember the driver isn’t your friend. If the machine is really damaged, don't accept it. If it has broken glass etc. They will not help take it into the store. They will put it near your door at best. Make sure you are there to accept the machine. Have people to help you uncrate the machine and watch any pertaining videos from the manufacturer. 

If it looks minor. Accept it and write on the BOL in large letters “accepted with damage further inspection needed possible hidden damage."  Make the driver call it into the dispatch  that there is damage. 

Do not sign for the machine till you inspect it. If they try to make you sign for it before they bring it down off the truck either climb up and inspect it or say “no you will need to call into your dispatch and say you refuse to let me inspect before I sign.”

Take as many photos and videos as you can. If boxing or packaging looks damaged. Take off and inspect before signing.

Perfecto Choco

All Perfect Chocolate Machine warranty claims will be directed to the manufacturer. ICES will assist in assuring prompt response and represent the client in any issues. Customs fee may apply to client. Warranty will be worked out directly with factory. ICES will aid and represent customer in working with factory and be their first line of outreach. There are no returns.

All Other Equipment Sold by Ice Cream Equipment Specialists

All build times are estimates only. ICES nor its vendors, partners, cannot give discounts or refunds due to elongated productions, shipping, or customs time. There are no returns. Only the manufacturer's factory warranty applies; ICES will assist the customer in ensuring all factory and warranty support that is supposed to be done by the factory. EmerymarkUSA is not responsible for damage during shipping. Please read the shipping instructions carefully. Do not sign the BOL without noting any damage. If the machine is on its side do not accept the machine. Failure to have proper power, ventilation, water, or water temperature may void the warranty. ICES may require customers to prove proper electrical, water pressure, ambient temperature, etc to ensure that correct hookups have occurred. Professional installation is recommended.

Demo or Used Equipment

This equipment is used and or demo equipment. The full factory warranty does not apply. Your representative will put in writing the warranty terms in the invoice.  Any used machines do not have a full warranty but have a decreased warranty put into writing by the sales representative.

Top Churn series

Below are the After-Sales Service Terms of Top Churn series displaying ice cream machine.

1. The manufacturer provides a 24-month warranty service for the equipment purchased by the Buyer (time calculated from the date of shipment). Free repairs are provided during the warranty period, labor and parts.
2. The manufacturer provides remote technical guidance to ensure correct repair by the Buyer for consumption components
3. During on-site repairs, the manufacturer bears the costs of lodging, travel expense, and spare parts; domestic logistics cost for sending repairs are borne by the manufacturer.
4. During the use of the equipment, if there are adjustability faults due to improper use by the Buyer, the manufacturer will provide remote guidance to assist in the proper operation of the equipment. If component damage is caused by improper use by the Buyer, the warranty policy does not apply. In this situation, the replacement costs are borne by the Buyer.
5. After the 24 month warranty, the Buyer has the option to purchase an extended warranty for each cylinder that will cost $800 annually. For this extended warranty, the Manufacturer will assume the cost of all replacement parts and shipping required for the machine.
